When police officers use deadly force without legal justification, the consequences are devastating and irreversible. Families are left grieving an unimaginable loss while also facing the arduous task of trying to hold powerful governmental entities accountable. These cases are among the most challenging civil rights lawsuits to litigate, requiring not only extensive legal knowledge but also aggressive advocacy and a willingness to challenge the official version of events. At Koufman Law Group, we are deeply committed to fighting for families whose loved ones have been wrongfully injured or killed by law enforcement. Our recent representation of the family of Alan Greenough demonstrates how unwavering dedication can uncover critical evidence and secure justice even in the most difficult circumstances.

Looking Beyond the Initial Police Narrative

The case arose from the fatal shooting of Alan Greenough by a Reading police officer in February 2018. After responding to a domestic disturbance call, officers arrived at an apartment where Mr. Greenough had barricaded himself before eventually fleeing through a rear window. Officer Erik Drauschke later located Mr. Greenough hiding inside a parked Hummer.

According to the officer, Mr. Greenough exited the vehicle, refused to remove his hands from the front pocket of his sweatshirt, and charged toward him, forcing the officer to fire two shots into Mr. Greenough’s chest. When Mr. Greenough’s brother reached the scene moments later, however, he found Alan kneeling near the Hummer, motionless. A subsequent search revealed no weapon on Mr. Greenough or anywhere near the vehicle.

Rather than accepting the official account at face value, Alan Greenough’s family turned to Koufman Law Group to investigate whether the shooting was legally justified.

Building the Case Through Independent Evidence

The attorneys at Koufman Law Group understood that determining what actually occurred required more than reviewing police reports. The firm retained independent experts to conduct their own investigation, including a shooting reconstruction specialist who carefully analyzed measurements, photographs, bullet trajectories, and physical evidence collected from the scene.

The reconstruction produced a dramatically different picture from the officer’s version of events. Based on the trajectory calculations and physical evidence, the expert concluded that Mr. Greenough could not have been charging toward Officer Drauschke immediately before he was shot because he was positioned too low to the ground. Instead, the evidence indicated he was kneeling, squatting, or sitting when the fatal shots were fired. This objective forensic analysis became a critical component of the family’s claims and demonstrated why independent investigation is often essential in excessive force litigation.

Challenging Qualified Immunity

On behalf of Mr. Greenough’s family, Koufman Law Group filed suit in the U. S. District Court alleging wrongful death and violations of Mr. Greenough’s constitutional rights based on the officer’s excessive use of force. After extensive litigation, the defense sought summary judgment, arguing both that the officer had acted reasonably and that qualified immunity shielded him from liability.

Koufman Law Group vigorously opposed the motion, by filing a strong opposition to it which demonstrated the physical evidence directly contradicted key aspects of the officer’s account of the shooting and created substantial factual disputes regarding whether deadly force was justified. The firm’s advocacy demonstrated that should the Judge rule on the motion for summary judgment, the Judge would most likely deny it and schedule the matter for a trial. The family would then be positioned to continue pursuing accountability by securing a verdict favorable to them.

A Resolution That Honored the Family’s Fight

As a result of Alan’s family’s shooting reconstruction by an expert and the strong opposition prepared by KLG, the defendant officer agreed to participate in mediation before a United States Magistrate Judge. During mediation, lawyers at KLG spoke about the shooting reconstruction and Alan Greenough’s family spoke about the devastating loss they continue to endure every day. Although no settlement could ever replace their loved one, the case ultimately resolved for $1 million, providing the family with a sense of justice and accountability.

The result reflects more than a financial recovery. It demonstrates the importance of compassionate representation, careful investigation, and attorneys willing to challenge official narratives through objective evidence. Without Koufman Law Group’s persistent and passionate advocacy, the inconsistencies in the officer’s account may never have been fully exposed.

Experienced Boston Civil Rights Attorneys

When families believe excessive force has resulted in the wrongful death or serious injury of a loved one, they deserve attorneys who will thoroughly investigate the facts and aggressively pursue justice. At Koufman Law Group, we combine experience in litigating complex cases with compassionate client advocacy to hold government actors accountable when constitutional rights are violated. Our office is located in Boston, and we represent individuals and families throughout Massachusetts. If you believe your family has been affected by police misconduct or excessive force, contact Koufman Law Group today to schedule a confidential consultation.

Criminal Defense and Immigration: Protecting Your Future in Massachusetts

For non-citizens, a criminal charge can carry consequences far beyond fines, probation, or incarceration. Even allegations that appear relatively minor can jeopardize immigration status, trigger removal proceedings, or create barriers to obtaining lawful permanent residency or citizenship. Because criminal and immigration law frequently overlap, every decision made during a criminal case must account for both the immediate charges and the long-term immigration consequences. If you are a non-citizen facing criminal allegations in Massachusetts, choosing an attorney who understands these high stakes can make all the difference. At Koufman Law Group, our trusted Boston criminal defense attorneys we regularly represent clients whose futures depend not only on the outcome of their criminal case, but also on protecting their ability to remain in the United States. Through strategic advocacy, meticulous trial preparation, and close coordination with immigration counsel when appropriate, we work tirelessly to pursue results that protect both our clients’ rights and their futures.

A Criminal Case Can Become an Immigration Case

Many people are surprised to learn that immigration authorities often do not wait for a criminal conviction before taking action. An arrest alone may trigger immigration consequences depending on a person’s immigration status and the nature of the allegations. Likewise, accepting what appears to be a favorable plea agreement in criminal court may ultimately create immigration consequences that are far more severe than the criminal penalties themselves.

Federal immigration law, not Massachusetts criminal law, often determines the immigration consequences of a criminal case. This means that even when a criminal matter appears to be resolved favorably in state court, the impact on a person’s ability to remain in the United States or pursue future immigration benefits may be very different. Certain convictions can affect admissibility, removability, eligibility for lawful permanent residency, or future naturalization. Because of these complexities, every strategic decision in a criminal case should be made with a full understanding of the potential immigration consequences. Successfully representing non-citizen clients often requires careful coordination between criminal defense strategy and immigration considerations.

A Not Guilty Verdict Protected One Client’s Future

One recent case involved a client charged in Woburn District Court with domestic assault and battery. In addition to the criminal case, the allegations resulted in a restraining order and created serious immigration complications while the criminal matter remained pending. Rather than allowing either proceeding to jeopardize the other, Attorney Caleb Koufman worked closely with the client’s immigration attorney to maintain the status quo while the client addressed the immigration issues that arose from the pending criminal allegations.

Once the criminal matter was ready for trial, Attorney Koufman presented evidence challenging the complainant’s credibility, including evidence that undermined the allegations presented against his client. Through careful cross-examination, he demonstrated that the complainant’s testimony was not credible and that the evidence did not support the prosecution’s theory of the case. After hearing all of the evidence, the judge found the client Not Guilty.

Attorney Koufman’s representation did not end with the acquittal. Approximately one month later, the parties returned to court for a hearing on the complainant’s request to extend the restraining order. After hearing argument, the judge denied the request and terminated the order. As a result, the client was able to move forward without a criminal conviction or an active restraining order affecting his future. This outcome required not only successful trial advocacy but also careful coordination of multiple legal proceedings to protect the client’s long-term interests.

As the client’s family later shared:

“If you are looking for a criminal defense attorney who truly listens and fights, look no further than Caleb Koufman. We retained him for a difficult case in Woburn District Court, and it was the best decision we could have made. The stakes were high, and the opposition was intense… Caleb remained composed, sharp, and dismantled the false narrative during the trial. We walked out with a Not Guilty verdict.”

Sometimes Going to Trial Is the Best Decision

In another matter, Attorney Koufman represented a client charged with operating under the influence in Malden District Court. Although resolving the case through a plea agreement was an option, doing so carried significant immigration concerns. Rather than recommending the quickest resolution, Attorney Koufman carefully evaluated the evidence and advised taking the matter to trial.

During trial, body-worn camera footage proved to be critical. Attorney Koufman demonstrated that the responding officer repeatedly yelled instructions during the standardized field sobriety tests and that the client did not understand what the officer was asking him to do. The evidence undermined the prosecution’s claims regarding impairment, and the judge ultimately found the client Not Guilty. By obtaining an acquittal, Attorney Koufman helped the client avoid both a criminal conviction and the immigration consequences that may have accompanied it.

Following the successful outcome, the client’s family wrote:

“Can’t say enough about Caleb. He is a very talented attorney who is kind and cares about his clients. He helped my partner with an issue at the Malden District Court. The best decision we made was having Caleb on our side. He is amazing, and I wouldn’t hesitate to recommend him to anyone.”

Choose an Attorney Who Sees the Bigger Picture

Not every criminal defense attorney understands how a criminal case can affect immigration status. Likewise, not every immigration attorney is equipped to defend criminal charges in court. Successfully representing non-citizens often requires more than knowledge of criminal law alone. It requires anticipating how every decision, from pretrial negotiations to trial strategy, may affect a client’s immigration future. At Koufman Law Group, we recognize these challenges and develop comprehensive defense strategies that account for both the criminal case and its potential immigration consequences. When appropriate, we also work closely with immigration counsel to ensure our clients receive coordinated legal representation.

If you are a non-citizen facing criminal charges in Massachusetts, you should not assume that the quickest resolution is the best one. The experienced Boston criminal defense attorneys at Koufman Law Group understand these high stakes and work diligently to develop defense strategies that protect both your legal rights and your future.

For licensed professionals, a criminal allegation can extend far beyond the courtroom. Doctors, nurses, and other healthcare providers in Massachusetts often face a dual challenge: defending against criminal charges while simultaneously responding to an investigation by a professional licensing board. A single allegation—such as drug diversion, fraud, assault, or operating under the influence—can trigger both proceedings, putting your freedom, reputation, and career at risk. If you are a professional charged with a crime or are under investigation by a licensing entity, understanding how these processes intersect is critical to protecting your future, and you should talk to a skilled Boston criminal defense attorney as soon as possible.

How One Allegation Can Lead to Two Proceedings

In Massachusetts, licensing boards operate independently from the criminal courts. As a result, a criminal charge can prompt a licensing investigation even before the criminal case is resolved. In some situations, an arrest or allegation alone may lead to immediate consequences, including temporary suspension or restrictions on your license.

Administrative proceedings differ in key ways from criminal cases. Licensing boards are not bound by the same strict rules of evidence, and the burden of proof is lower than the “beyond a reasonable doubt” standard required for a criminal conviction. This means a professional could avoid criminal liability but still face discipline, including suspension or revocation of a license. At the same time, statements made in a licensing matter may later be used in a criminal case if not handled carefully. These overlapping risks make it essential to approach both matters strategically.

Why a Coordinated Defense Matters

Professionals sometimes treat criminal charges and licensing issues as separate problems, handled by different attorneys. While that approach may seem practical, it can create serious risks. Decisions made in one case, such as providing testimony, submitting documents, or negotiating a resolution, can directly impact the other.

Without coordination, a defense strategy that helps in criminal court could inadvertently harm a licensing case, or vice versa. For example, responding to a licensing board inquiry while a criminal case is pending may raise concerns about self-incrimination. Inconsistent positions or poorly timed disclosures can weaken both defenses. A unified legal approach ensures that each step is taken with a full understanding of its broader implications.

The Benefit of One Firm Handling Both Matters

A coordinated defense managed by one legal team offers a significant advantage. At Koufman Law Group, we regularly represent medical professionals facing both criminal charges and licensing board actions. Handling both matters together allows us to develop a consistent, strategic approach tailored to each client’s goals.

This means carefully managing communications, aligning legal arguments, and making informed decisions about how and when to respond to each proceeding. In some cases, resolving a criminal matter in a particular way can reduce the likelihood of severe licensing consequences. In others, preserving a professional license may influence how the criminal defense is structured. Having one firm oversee both cases helps ensure that these strategies work together rather than at cross purposes.

Speak with an Experienced Boston Defense Attorney

If you are a doctor, nurse, or other licensed professional facing criminal charges, it is important to seek legal guidance as soon as possible.

If you are facing criminal charges in Massachusetts, it is important to understand that not every criminal case is handled in the same court. Depending on the nature of the allegations, a case may proceed through District Court, Superior Court, or Federal Court, each of which has its own procedures, rules, and strategic considerations. For doctors, nurses, and other licensed professionals, criminal allegations can also trigger administrative proceedings before professional licensing boards, creating an entirely separate legal battle that can threaten a career even if the criminal matter is resolved favorably. Because these overlapping systems can significantly affect one another, it is critical to work with an attorney who understands how to navigate all of them. At Koufman Law Group, we represent clients throughout Massachusetts in criminal matters at every court level, as well as professionals facing licensing board complaints and disciplinary actions.

Understanding the Role of District Court

Massachusetts District Courts handle a wide range of criminal matters, including many misdemeanor offenses and certain felony cases during the early stages of prosecution. Charges such as operating under the influence, assault and battery, shoplifting, drug possession, and domestic violence offenses are frequently heard in District Court. These courts often handle arraignments, bail determinations, probable cause hearings, and pretrial proceedings.

While some cases remain in District Court through resolution, others may eventually be transferred to Superior Court if the allegations are more serious. The early stages of a criminal case are critical, as statements made, evidence introduced, and strategic decisions at this point can influence the outcome later in the proceedings. Having an attorney familiar with District Court practice can make a meaningful difference in protecting your rights from the outset.

How Superior Court Differs

Superior Court handles the most serious state criminal offenses in Massachusetts, including major felonies that may carry substantial prison exposure. Cases involving drug trafficking, firearm offenses, aggravated assaults, white collar crimes, and homicide allegations are commonly prosecuted at this level.

Superior Court litigation is often more complex and intensive than proceedings in District Court. These cases may involve grand jury indictments, extensive discovery, expert witnesses, forensic evidence, and significant pretrial motion practice. Trials in Superior Court can also require a sophisticated understanding of evidentiary rules and constitutional issues. Because the stakes are often significantly higher, it is important for anyone facing charges in Superior Court to work with counsel experienced in handling serious felony litigation and jury trials.

Federal Criminal Cases Present Unique Challenges

Federal criminal cases differ substantially from state prosecutions and are governed by an entirely separate set of procedural and evidentiary rules. Federal investigations are often conducted by agencies such as the FBI, DEA, or Department of Health and Human Services. They may involve allegations of healthcare fraud, drug distribution conspiracies, wire fraud, or other complex offenses.

Federal prosecutors typically spend months or even years building cases before charges are filed, meaning individuals may already be under extensive investigation without their knowledge. Sentencing in federal court is also governed by federal sentencing guidelines, which can create severe consequences if not carefully addressed. Successfully defending federal cases requires familiarity with federal procedure, motion practice, and investigative tactics that differ substantially from state court litigation.

The Overlap Between Criminal Cases and Licensing Board Complaints

For licensed professionals such as physicians and nurses, criminal charges often lead to parallel proceedings before licensing boards. A doctor facing allegations of healthcare fraud or a nurse charged with drug-related offenses may suddenly find themselves defending not only a criminal prosecution but also a complaint before the Board of Registration in Medicine or Board of Registration in Nursing.

These administrative proceedings operate under different standards than criminal courts and can proceed even if criminal charges are dismissed or reduced. Statements made in one matter can also affect the other if not strategically managed. Without careful coordination, attempts to defend a professional license may inadvertently create risks in the criminal case, or vice versa.

Many clients have expressed how valuable it is to work with one law firm capable of handling both matters simultaneously. A coordinated approach enables a consistent legal strategy, careful communication management, and a comprehensive understanding of how each proceeding affects the others.

Why Broad Experience Matters

Every court system presents different challenges, procedures, and risks. An attorney who regularly practices in District Court may not have substantial federal trial experience. At the same time, a lawyer focused solely on criminal defense may not understand the nuances of professional licensing board proceedings. When your freedom, livelihood, and reputation are all at stake, having counsel with experience across these forums can provide a significant advantage.

At Koufman Law Group, we understand how criminal allegations can affect every aspect of a client’s life. We regularly represent clients in Massachusetts District Courts, Superior Courts, Federal Courts, and administrative licensing proceedings, allowing us to develop comprehensive defense strategies tailored to each client’s circumstances.
