Property Division

Many times when a couple divorces, division of marital property is an issue that becomes very emotionally charged. There are several factors which need to be considered, and they can be completely different from case to case. We have the experience needed to help you survive the emotions and focus on the facts of your case.
KLG attorneys know that “equitable” is not necessarily “equal” and we take that into account when representing our clients either in negotiations or in the courtroom.
Massachusetts is an “equitable division” state. This means the marital assets will be distributed fairly, not equally. Generally the courts will start at a 50/50 split of property and then take equity into consideration.
Professional ExperienceThe attorneys at KLG, are experienced in gathering the information concerning the property to be divided, including:
- Home equity
- Vacation property and other real estate
- Retirement accounts/401(k) plans
- Business holdings
- Stocks/stock options
- Investments
- Inheritance
How do you put a value on potential inheritance or stock options? Let our network of professionals help determine this for you. When you meet with us we will help you complete a financial statement. Once we have the statement we will do our best to anticipate what the courts will do, based on our experience. The goal is for an equitable split, but if the other party insists on receiving more than an equitable share, we will aggressively defend your rights in court.
